Terms of Service

These are draft terms governing your use of the SophieSMC platform and software (the Scanner, SophieSMC X, and related tools). By purchasing or using the software, you agree to these terms. They mirror the license terms of the existing SophieSMC store and will be finalized before launch.

1. The software license

• Each purchase grants a limited, non-transferable license to use the software. You may not resell, share, rent, lend, or otherwise transfer your license or license key to another person.
• Each license covers one MT5 account and one broker/server unless the product description states otherwise. Moving a license to a different account or server requires contacting support.
• You may not reverse-engineer, decompile, or attempt to extract the source code of the software.
• Access, delivery, or download instructions are provided after purchase. You are responsible for keeping your license key and account credentials private.

2. What the software is (and is not)

SophieSMC software is an educational and analytical tool. It detects market-structure patterns (such as fair value gaps, order blocks, BOS, and CHoCH), displays trade-plan context, and can manage order execution in MetaTrader 5 according to plans you accept. It is not a financial advisor, and it does not provide investment, trading, legal, or tax advice.

3. No guaranteed outcomes

There is no guarantee of profit, performance, compatibility with any broker, or fitness for any particular trading strategy. Trading involves substantial risk of loss, and you assume the full risk of every trade you place. Please read the Risk Disclosure and the Disclaimer before trading.

4. Acceptable use

• Use the software only on accounts you own or are authorized to trade.
• Do not use the software to attempt to manipulate markets, exploit broker errors, or violate any broker’s terms of service or applicable law.
• Do not circumvent license verification, trial limits, or activation mechanisms.
• Do not publish or redistribute the software, its panel content, or its documentation without permission.

We may suspend or terminate licenses that violate these terms, with or without prior notice, and without refund where the violation is deliberate.

5. Subscriptions and journal services

Placeholder — to be finalized at launch. If the platform offers subscription products (such as hosted journal sync or data services), the billing period, renewal, cancellation, and refund rules specific to each subscription will be stated on the product page and in these terms before any subscription is offered for sale. No recurring billing exists today.

6. Pricing and payment

Prices are as displayed at checkout. Payments are processed securely by Stripe; we never see or store your card details. If a pricing error is discovered before delivery, we may cancel the order and refund you in full.

7. Limitation of liability

To the maximum extent permitted by law, SophieSMC is not liable for any trading losses, missed opportunities, software downtime, or indirect or consequential damages arising from the use of the software. Our total liability for any claim is limited to the amount you paid for the product in question.

8. Changes

We may update these terms; material changes will be announced and the “Last updated” date revised. Continued use after changes take effect constitutes acceptance.
